Welcome to ChunkyChic Branding Studio. These Terms & Conditions govern your use of the ChunkyChic Branding Studio website and the purchase of products, custom merchandise, branding services, design services, and related services offered by ChunkyChic Branding Studio.
By accessing our website, requesting a quote, submitting an order, approving a design proof, making a payment, or purchasing products or services from ChunkyChic Branding Studio, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
1. Services & Custom Orders
ChunkyChic Branding Studio provides custom branding, apparel, promotional products, personalized merchandise, creative design services, branded gifts, and related products and services for businesses, schools, childcare centers, churches, nonprofits, organizations, groups, and individuals.
Because many of our products are customized specifically for each client, custom orders are subject to the approval, payment, cancellation, return, and production policies outlined below.
2. Quotes & Pricing
All quotes are based on the specifications provided by the client at the time the quote is prepared, including product type, quantity, sizes, colors, artwork, personalization, decoration method, packaging, delivery requirements, and production timeline.
Unless otherwise stated in writing, quotes are valid for 30 days.
Pricing may change if the client changes the quantity, product selection, artwork, personalization, production requirements, delivery method, or other specifications after the original quote is issued.
A quote does not reserve inventory, materials, or production time until all required payment and order requirements have been satisfied.
3. Payment & Deposits
Orders totaling less than $1,000 require payment in full before production begins, unless otherwise agreed to in writing.
Orders totaling $1,000 or more require a 50% deposit before materials are ordered or production begins. The remaining balance must be paid before the completed order is shipped, delivered, or released for pickup unless different payment terms have been approved in writing by ChunkyChic Branding Studio.
Production will not begin until all required payments, artwork, information, and approvals have been received.
Any additional work or products requested after approval may result in additional charges.
4. Design Services & Artwork
Design fees may apply when ChunkyChic Branding Studio creates, modifies, redraws, prepares, or otherwise develops artwork for a client's order.
Design fees cover the creative service provided and do not automatically transfer ownership of original artwork, design files, editable files, source files, templates, or other intellectual property unless ownership rights are expressly transferred in writing.
Clients will receive the finished products and/or approved deliverables included in their order.
5. Proofs & Customer Approval
When a proof is provided, the client is responsible for carefully reviewing all details before approving production.
This includes, but is not limited to:
Spelling and grammar
Names and dates
Phone numbers, website addresses, and contact information
Product quantities
Apparel sizes
Colors
Artwork
Logo placement
Personalization
Layout and design
Once the client approves a proof, that approval is considered authorization to produce the order as shown.
ChunkyChic Branding Studio is not responsible for errors contained in an approved proof that were present and reasonably visible at the time of customer approval.
Changes requested after approval may result in additional design, material, and production charges and may affect the completion date.
6. Customer-Supplied Artwork, Logos & Intellectual Property
Clients who provide logos, photographs, graphics, trademarks, copyrighted material, slogans, artwork, or other content represent that they own the material or have the necessary authorization and rights to use it for the requested products.
ChunkyChic Branding Studio is not responsible for determining ownership of customer-supplied content.
Clients are responsible for claims resulting from their unauthorized use of third-party intellectual property to the extent permitted by applicable law.
ChunkyChic Branding Studio reserves the right to decline any project that we reasonably believe may infringe upon another party's intellectual property rights or otherwise violate applicable law.
7. Product Colors & Variations
Colors displayed on computer monitors, phones, tablets, printed proofs, or other electronic devices may differ slightly from the final physical product.
Variations may also occur between product batches, garment manufacturers, materials, printing methods, sublimation, heat-transfer processes, embroidery, or other production methods.
Reasonable variations inherent in custom manufacturing or decoration are not considered defects.
8. Apparel Sizing
Sizing may vary between brands, styles, manufacturers, and garment types.
Clients are responsible for reviewing available size information and selecting the appropriate sizes before approving an order.
Because customized apparel is produced specifically for the client, products generally cannot be returned or exchanged because an incorrect size was selected by the customer.
9. Production & Turnaround Time
Our standard production turnaround is generally 7–10 business days unless otherwise stated.
Turnaround time begins after ChunkyChic Branding Studio has received:
Required payment + final artwork/design approval + all required order information.
Weekends, holidays, shipping/transit time, and delays caused by incomplete customer information or approval are not included in standard production time.
Large-volume, specialty, complex, or outsourced orders may require additional production time. We will communicate the applicable timeline when reasonably possible.
10. Rush Orders
Rush service may be available depending on product availability, production capacity, and the complexity of the order.
Rush orders may incur an additional fee.
Payment of a rush fee does not eliminate delays caused by circumstances outside the reasonable control of ChunkyChic Branding Studio, including carrier delays, manufacturer shortages, severe weather, supply-chain interruptions, or other unforeseen events.
11. Order Changes
Clients should verify all order specifications before final approval.
Changes requested after products or materials have been ordered may result in additional charges.
Changes requested after production has begun may not be possible.
If a requested change can be accommodated, the client is responsible for additional material, design, labor, shipping, or production expenses resulting from that change.
12. Cancellations
Orders may be canceled before materials have been ordered and before production has begun.
However, completed design, artwork, setup, consultation, sourcing, or other services already performed are non-refundable.
Once materials have been purchased specifically for the client's order, customization has begun, or production has started, the order cannot generally be canceled or refunded.
If ChunkyChic Branding Studio agrees in writing to an exception, any refund will be reduced by costs already incurred in connection with the order.
13. Custom Products, Returns & Refunds
Because custom and personalized products are created specifically for each customer, all approved custom-product sales are generally final except when ChunkyChic Branding Studio makes a production error or supplies a defective product.
We do not generally accept returns or provide refunds for:
Customer change of mind
Incorrect size selected by the customer
Customer-provided spelling or information errors
Errors contained in an approved proof
Reasonable color variations
Minor variations inherent in custom production
Customer misuse, improper washing, handling, or care after delivery
Nothing in these Terms is intended to eliminate any rights or remedies that cannot legally be waived.
14. Defective, Damaged or Incorrect Orders
Customers should inspect their order promptly upon receipt.
Claims involving damaged, defective, missing, or incorrectly produced merchandise must be reported to ChunkyChic Branding Studio within 3 business days of delivery or pickup.
Please include the order information and clear photographs showing the issue when applicable.
We may request that affected merchandise be returned or made available for inspection before determining the appropriate remedy.
If ChunkyChic Branding Studio confirms that an item was defective or produced incorrectly due to our error, we may, as appropriate, repair the item, replace it, reproduce the affected portion of the order, issue a credit, or provide another appropriate remedy.
15. Shipping, Delivery & Pickup
Shipping and delivery estimates are provided in good faith but are not guaranteed unless expressly agreed to in writing.
ChunkyChic Branding Studio is not responsible for delays caused by shipping carriers, severe weather, incorrect customer-provided addresses, or other circumstances outside our reasonable control.
Customers are responsible for providing complete and accurate shipping and delivery information.
Applicable shipping, delivery, or local delivery fees will be communicated before the order is finalized when practicable.
16. Intellectual Property
Unless otherwise stated, the ChunkyChic Branding Studio name, website content, original graphics, photographs, branding materials, original designs, marketing materials, text, and other original content created and owned by ChunkyChic Branding Studio are protected by applicable intellectual-property laws.
Our content may not be copied, reproduced, distributed, sold, modified, or commercially used without permission except as permitted by law.
Customer-owned logos and other intellectual property remain the property of their respective owners.
17. Portfolio & Promotional Use
Unless confidentiality has been agreed to in writing, ChunkyChic Branding Studio may photograph completed products and use photographs or representations of completed work for portfolio, website, social-media, marketing, advertising, or promotional purposes.
This provision does not transfer ownership of a client's trademarks, logos, or other intellectual property to ChunkyChic Branding Studio.
Clients who require confidentiality should notify us in writing before production begins.
18. Website Use
Users agree not to misuse this website, attempt unauthorized access, interfere with website functionality, introduce malicious software, unlawfully collect information, or use the website for illegal purposes.
Website content is provided for general informational and commercial purposes and may be changed without notice.
19. Cookies & Third-Party Services
Our website may use cookies and similar technologies necessary for website functionality, analytics, security, marketing, and improving the customer experience.
Certain website functions may also rely on third-party providers, including payment processors, scheduling platforms, analytics services, embedded media, shipping services, or other technology providers.
Use of those third-party services may also be governed by the providers' respective terms and privacy policies.
Where required by applicable law, users will be provided appropriate choices regarding non-essential cookies.
20. Limitation of Liability
To the fullest extent permitted by applicable law, ChunkyChic Branding Studio will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website, products, or services.
To the fullest extent permitted by applicable law, our aggregate liability arising from a particular order or transaction will not exceed the amount actually paid to ChunkyChic Branding Studio for the portion of the order giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
21. Events Beyond Our Reasonable Control
ChunkyChic Branding Studio will not be responsible for delays or failure to perform caused by circumstances reasonably beyond our control, including severe weather, natural disasters, power or internet outages, transportation interruptions, supplier or manufacturer disruptions, government actions, labor disruptions, or carrier delays.
We will make reasonable efforts to communicate significant delays and complete affected orders as circumstances permit.
22. Governing Law
These Terms & Conditions are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
23. Changes to These Terms
ChunkyChic Branding Studio may update these Terms & Conditions periodically.
Updates will become effective when the revised Terms are posted on our website unless otherwise stated. The "Last Updated" date at the top of this page will reflect the latest revision.
Orders already accepted will remain subject to the terms applicable to that transaction unless otherwise required by law or agreed to in writing.
